Once Again: Huawei Hongmeng OS trademark rejected

It’s the second time when Huawei got a rejection for the Hongmeng trademark name. A recent report informed that the company’s self-developed Hongmeng OS, globally known as HarmonyOS once again rejected by the Beijing Intellectual Property Court.

According to the information, Huawei applied for a lawsuit against the China National Intellectual Property Administration (CNIPA) in Beijing court. The ground for the challenge was the decision to reject the HongMeng trademark with application no. is 38684797.

It’s said that the Beijing court marked the decision of CNIPA as right. And, concluded that the Chinese combination for Hongmeng has a similar meaning and texture as a present trademark. If another Hongmeng gets permission, it’ll only create confusion for the consumers and violate the trademark right.

Therefore, the company ended up facing another Hongmeng trademark rejection and left with choices of either changing the name to modified the wordings. To be mentioned, this Chinese smartphone maker applied for the mark under class 38 of the international classification of telecommunication equipment and services.

The patent and trademark controversy are normal in the industry but necessary as well. Because a trademark is the identification of a brand that is really needed to survive in the field. Meanwhile, the procedure of licensing the name is also too long, as it contains several phases such as application, examination, and others.
